Limited Three (3) Year Warranty

TrailerFlex™, makes every effort to assure that its products meet high quality and durability standards, and warrants to the original purchaser that this product is free from defects in materials and workmanship. The TrailerFlex™ brand Limited 3-year warranty covers certain TrailerFlex brand products that have been specifically identified for inclusion in this program.  This warranty is in effect for three (3) years, from the time of sale, for the original retail purchaser of the product.  This warranty is terminated after 3 years from the date of purchase, or when the original retail purchaser sells or otherwise transfers the product to any other person or entity during the three-year warranty period. This Limited 3-year warranty is for the structural metal base component only, including all weld seams, and does not apply to ancillary components or items, not a part of the base metal welded structure. TrailerFlex™ warrants the attachment hardware and accessory components specifically and excluding all other items, the “Backup Indicator Aid”/fiberglass marker poles, provided “Security Star Knobs”, zippered gear bag, any security cable assemblies, locks, and any other accessories for Thirty (30) days to the original purchaser only. This does not include decals, screws, and/or any components not covered specifically under the above warranty.  Rusting is possible with any welded metal product and is not covered under any warranty. Maintenance, care, and rust prevention, including touch-up painting, is the sole responsibility of the original purchaser.

Subject to the limitations and exclusions described in this warranty, TrailerFlex will remedy defects in materials and/or workmanship by repairing or replacing, at its option, a defective product without charge for parts or labor. TrailerFlex may elect, at its option, not to repair or replace the defective product but rather issue to the original retail purchaser a refund equal to the purchase price paid for the product, or credit to be used toward the purchase of a replacement TrailerFlex product. This warranty is void if the product is not used, installed, and maintained in accordance with the provided instructions.

This warranty does not cover, and no warranty is given for defects or problems caused by normal wear and tear, which includes but is not limited to, surface (aesthetics), metal corrosion, scratches, dents, deformities, accidents, unlawful vehicle operation, misuse, abuse, negligence, criminal activity, improper installation, lack of maintenance, or any modification of a product not performed or authorized in writing by Trailerflex.

In Addition, this warranty does not cover problems resulting from conditions beyond TrailerFlex (S&D Group) control including, but not limited to, theft, misuse, overloading, or failure to assemble, mount or use the product in accordance with TrailerFlex written instructions or guidelines included with the product provided to the original retail purchaser. THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS.

No warranty is given for TrailerFlex™ brand products sold outside of the continental United States, Canada, and Mexico.

If the product is believed to be defective, the original retail purchaser should contact the Trailerflex dealer from whom it was purchased, who will give the original retail purchaser instructions on how to proceed. If the original retail purchaser is unable to contact the TrailerFlex dealer, or the dealer is not able to remedy the defect, the original retail purchaser should contact TrailerFlex by email at info@trailerflex.com.

 

In the event that the product must be returned to TrailerFlex, a technician or CS representative at the email address above will provide the original purchaser with return shipping instructions. The original purchaser will be responsible for the cost of mailing the product to TrailerFlex.  In order to be eligible to receive any remedy under this warranty, a copy of the original purchase receipt, a description of the defect, and a return address must be provided. In addition, the product must be registered on the warranty page at www.trailerflex.com.

  1. General Disclaimer:

Our product is designed as an add-on to utility trailers and is intended to improve their functionality. However, the use of this product introduces additional factors that may affect the performance, safety, and overall operation of your trailer. It is essential to exercise caution and follow proper guidelines to ensure a safe experience.

  1. Proper Installation:

Before using this product, ensure it is correctly installed on your utility trailer according to the provided instructions. Incorrect installation may compromise the stability and structural integrity of your trailer, leading to accidents, property damage, or personal injury.

  1. Weight and Load Distribution:

Take into consideration the additional weight introduced by this product. Overloading the trailer beyond its manufacturer-recommended capacity can lead to instability, reduced vehicle control, and the risk of accidents. Always adhere to weight limits and load distribution guidelines provided by both the trailer and product manufacturers.

  1. Regular Inspection and Maintenance:

Always ensure that the equipment is securely attached to the utility trailer and regularly inspect the product and all its components for signs of wear, damage, or loosening. Proper maintenance is necessary to ensure safe and optimal performance. Failure to maintain the product may result in accidents, property damage, or personal injury.

 

  1. Adapted Driving Behavior:

The addition of this product to your utility trailer may alter driving dynamics, including braking, turning, and maneuverability. Practice driving in a controlled environment before using the trailer on busy roads or in challenging conditions to become familiar with any changes in handling.

  1. Limited Warranty:

Repair or replacement of a defective product, or the issue of a refund or credit (as determined by TrailerFlex™) is the original retail purchaser’s sole and exclusive remedy under this warranty.  Damage to the original purchaser’s vehicle, cargo, or property and/or to any other person or property is not covered by this warranty.  This warranty is void if the product is not used, installed, and maintained in accordance with the provided instructions.

This warranty is expressly made in lieu of any, and all other warranties, express or implied, including the warranties of merchantability and fitness of a particular purpose.

Trailerflex’s sole liability to any purchaser is limited to the remedy set forth above. In no event will TrailerFlex be liable for any direct, indirect, consequential, incidental, special, exemplary, or punitive damages, or, for any other damages of any kind or nature (including but not limited to, lost profits, lost income, or lost sales).

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not be applicable.

  1. Assumption of Risk and Release of Liability:

In addition, all vehicular transports are potentially hazardous. Any person(s) using TrailerFlex ™ brand products are personally responsible for following the given directions for use and/or installation and voluntarily assumes and accepts full responsibility for any, and all damages, or injury of any kind including death, which may result from their use and/or installation. To the maximum extent permitted by law, TrailerFlex ™ and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or misuse of this product. This includes, but is not limited to, damages to property, personal injury, or any other loss resulting from product use.
